ORDINANCE NO. 530

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE

CITY OF CRESCO, IOWA, BY AMENDING

PROVISIONS PERTAINING TO WATER METERS

BE IT ENACTED by the City Council of the City of Cresco, Iowa, as follows:

SECTION 1.   Chapter 91, Section 09 of the Code of Ordinances of the City of Cresco, Iowa, is repealed and the following adopted in lieu thereof:

91.09 RIGHT OF ENTRY. The property owner and customer consent to entry by the Superintendent at any reasonable time to read, remove or change a meter. If the owner and customer do not cooperate, not only can the City charge the surcharge, but the City has the discretion to turn off the water, after written notice to the property owner.

SECTION 2. NEW SECTION. The Code of Ordinances of the City of Cresco, Iowa, is amended by adding section 91.13 entitled WATER METER SURCHARGE, which is hereby adopted to read as follows:

91.13 WATER SURCHARGE. Any property owner who fails to timely comply with the installation requirements of the water meter of Section 91.04 or Section 91.09 of this chapter shall be subject to a monthly surcharge in the amount of one hundred dollars ($100.00), which shall be added to the property owner’s or tenant’s City water bill. The surcharge shall commence on the first day of the month following the expiration of a thirty (30) day period after the property owner has failed to timely allow installation by the City, as required under this chapter. The surcharge shall continue to be imposed for each month the property owner continues to own the property without complying with the applicable requirements of this chapter. This monthly surcharge is intended to offset the additional costs incurred by the City in maintaining and reading the water meter on a monthly basis.

SECTION 3.  SEVERABILITY CLAUSE.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 4.  WHEN EFFECTIVE.  This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
